- On 27 September 1930 The Brisbane Courier reported:- " TOOWOOMBA, September 26.
In the Magistrate's Court to-day, before Mr. F. C. M. Burne, P.M., George Keding, of Douglas, via Goombungee, proceeded against the Queensland Probate Insurance Company, Limited, claiming £12/4/8, being the amount paid to the defendants on a probate policy issued to the plaintiff on the life of his father, Julius Herman Keding, which payment, it was alleged, the plaintiff was induced to make by the fraudulent misrepresentation on the part of the defendant's district manager, E. W. A. Virgo.
Mr. W. I. Garde appeared for the plaintiff, and Mr. M. J. O'sullivan for the defendant company.
Mr. Garde said that the plaintiff was a farm hand, and lived with his father at Goombungee. In February E W. A. Virgo, district superintendent for the Queensland Probate Insurance Company, went to the plaintiff's father's house and inquired if he had a probate insurance policy on his life. On being told that he had, Mr. Virgo asked for the policy to be produced. Mr. Virgo examined the policy, which had been taken out with the Equitable Life Assurance Company. The evidence would show that Mr. Virgo told the plaintiff's father that the policy was of no value, as the amount would not be paid by the company for some time after the death of the insured. On the representations made by Mr. Virgo the plaintiff was induced to take put a policy with the Queensland Probate Insurance Company, on which he paid a premium of £12/4/8. Subsequently the plaintiff found that the statements made by Mr. Virgo were untrue, and made a claim against the company for a refund of the premium.
Evidence in support of the claim was given, after which Mr.-O'sullivan asked for a nonsuit on the grounds that there was no evidence of misrepresentation, or that there was any evidence to show that any statement made by Mr. Virgo was untrue.
The Police Magistrate: I fail to see any evidence at all of misrepresentation.
Mr. O'sullivan: It is really only a squabble between, the two insurance companies.
The Police. Magistrate: It is, and I am called upon to settle it.
Mr. E. W. A. Virgo, district superintendent for the defendant company, denied that there had been any misrepresentation, and said that he pointed out that under the policy which plaintiff's father was insured his beneficiaries would be liable for probate and a certain amount of succession duty. He said it was an excellent policy, but for probate purposes it did not fill the bill. He pointed out that there were only two Queensland probate insurance offices operating, and that the insurance legislation of Queensland was superior to any other, because companies operating in Queensland were required to deposit with the Queensland Government up to £50,000 for the ample security of the policy holders. Witness was formerly chief Inspector for the Equitable Life Assurance Company.
The Police ,Magistrate found that there had been no misrepresentation on the part of the Q.P.I, superintendent, and gave a verdict- for the defendants, with costs amounting to £4/19/." - At the age of 30 years, George Keding married Sylvia Lau, daughter of John Jacob Lau and Anna Maria Auguste Abraham, in 1934 in Queensland.
