To Mr. Cummins: The promise was made on November 7th; defendant did not mention anything about the mother: he said he would pay for the girl; this would he about a fortnight before the girl left.
Senior-Constable Fletcher deposed: He knew both plaintiff and defendant; he had been subpoenaed to produce papers filed in connection with a previous case set down for hearing.
Mr. Cummins objected to the papers being produced. The case had never came before the Court, Had been settled, and the papers might contain anything at all. The P.M., after argument, upheld the objection.
Witness (continuing) said he heard I defendant say he would pay all expenses in connection with the child: he said this before several other witnesses.
Alice Stains, sen, deposed that her daughter was confined at the house of Charles Banwell; did not see defendant at any time; heard defendant say he I would pay all expenses on the child: had taken out a summons against him; this was settled; when the case was settled he said he would pay the board; the case had been settled for £2 2s, which she (witness) had received; all she heard him say was that he would pay all expenses on the child.
Alice Stains, jun., knew defendant Small ; had charged him with being the father of her illegitimate child :-she was taken to Banwell's to be confined, witness did not hear Small say that he would pay for her board ; she would swear it.
