The defendant counter- claimed for the sum of £9 damages alleging that the plaintiff, whilst he had defendant's car in the garage for sale, allowed the said car to be used and insured the same without authority which Cost the defendant the sum of £9 to regain. Mr Frank Hennessy (of Messrs. Hennessy and Hennessy) appeared for the plaintiff and Mr. Frank Brennan appeared for the defendant. The defendant admitted the plaintiff's claim for goods sold and delivered and after hearing evidence the Police Magistrate found that the car had been used by the plaintiff, and allowed damages for the defendant amounting to £4/10/, with costs, making in total of £7/17/. Judgment for the plaintiff with costs (£5/8/7) was given, leaving a balance in favour of the defendant of £2/18/5."
